Subject: 9833 1992-208 Chattanooga Art Association Date: Mon, 27 Feb 1989 12:20:00 -0500 1992-208 Chattanooga Art Association ORDINANCE NO. 9833 AN ORDINANCE CLOSING AND ABANDONING BLUFF VIEW AVENUE LOCATED NORTHWEST FROM EAST 2ND STREET, SOUTHWEST OF SPRING STREET, MORE PARTICULARLY DESCRIBED HEREIN, UPON CERTAIN CONDITIONS. _______________________ SECTION 1. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHATTANOOGA, TENNESSEE, That there be and is hereby closed and abandoned Bluff View Avenue located northwest from East 2nd Street, southwest of Spring Street, more particularly described herein, and as shown on plat attached hereto and made a part hereof by reference: Bluff View Avenue, a right-of-way varying in width from 50 feet to 60 feet, and beginning on the northwest line of East 2nd Street 263 feet southwest of the intersection of the northwest line of East 2nd Street with the southwest line of Spring Street, said point being the southwest corner of lot 21, Bluff View, as shown by plat of record in Plat Book 1, Page 22, ROHC, thence southwest 60 feet with East 2nd Street to the southeast corner of lot 1, said Bluff View subdivision, thence northwest 29.7 feet with the northeast line of said lot 1, thence northwest and northeast 503 feet with the northeast and southeast line of lots 1-10, said subdivision, to the northeast corner of lot 10, thence southeast 50 feet with the extension of the northeast line of lot 10 to a point in the northwest line of lot 13, thence southwest and southeast some 485 feet with the northwest and southwest line of lots 13-20 to a point in the northwest line of lot 21, thence southwest some 18 feet with the northwest line of lot 21 to a corner, thence southeast 26.4 feet with the southwest line of lot 21 to the northwest line of East 2nd Street, the point of beginning. Tax Map Number 135L-D-3-10 and 135L-E-2. SECTION 2. BE IT FURTHER ORDAINED, That this closure and abandonment is made subject to the following conditions: 1. A recreation easement be granted for construction and maintenance of the proposed riverwalk as shown on the attached drawing. This recreation easement should extend a minimum of ten feet on each side of the center line of the riverwalk as shown on the enclosed drawing. 2. Fire Department access should be maintained for emergency response equipment and necessary adjustments for the payment of fees for the fire hydrant (H-4155) locate on Bluff View Avenue be made. 3. The Electric Power Board of Chattanooga has distribution facilities located within said right-of-way which must be maintained for the use and benefit of its customers and an easement the width of the entire right-of-way is reserved for the operation, maintenance, rebuilding, and replacement of these distribution facilities. 4. The reservation for the Tennessee-American Water Company of an easement the width of the right-of-way for the purpose of operating and maintaining their facilities located within the right-of-way. 5. Reservation of an easement the width of the right-of-way for South Central Bell for the purpose of operating and maintaining its facilities in said right-of-way. 6. The areas reserved for utility easements must be kept free and clear of all structures. 7. All existing easements are retained. 0C SECTION 3. BE IT FURTHER ORDAINED, That this Ordinance shall take effect two weeks from and after its passage as provided by law.
